By submitting a laboratory case, referring a patient, or using our website, you agree to be bound by these Terms.

1. Definitions Relevant to Dental Laboratory Services

• “Practitioner”: Any registered dental professional, including but not limited to general dentists, dental specialists, and dental prosthetists, who submits a prescription or laboratory request to van Noorden Dental Laboratories.
• “Patient”: The individual receiving treatment from the Practitioner for whom the prescribed dental prosthetic is intended.
• “Services”: The dental laboratory services we provide, including but not limited to the fabrication, repair, or adjustment of dentures, implant-supported prosthetics, and chrome frameworks.
• “Lab Work”: Any dental appliance, device, or prosthesis produced by us based on the Practitioner’s prescription or referral.
• “We”, “Us”, “Our”: Refers to van Noorden Dental Laboratories Pty Ltd and its directors, employees, contractors, and authorised representatives.

2. Scope of Dental Laboratory Services Provided

We provide custom dental prosthetic services based on prescriptions provided by qualified Practitioners. All Services are provided in accordance with the information, impressions, and instructions supplied by the Practitioner.

3. Case Acceptance & Processing

• All cases must be accompanied by a completed lab docket or digital prescription.
• We reserve the right to reject any case that is incomplete or contains insufficient information.
• It is the responsibility of the Practitioner to ensure that impressions, digital scans, and instructions are accurate.

4. Delivery and Turnaround Times for Dental Appliances

• Typical turnaround times are 5–7 working days, depending on the type of Lab Work.
• Urgent or priority services may be available on request.
• While we strive to meet deadlines, turnaround times are estimates and may vary due to complexity, volume, or material availability.

5. Pricing and Payment Terms for Dental Products

• Prices for Services are listed in our current fee schedule, which is available upon request.
• Payment is due within 14 days from the invoice date unless otherwise agreed.
• We accept EFT, credit card, and other standard payment methods.
• Late payments may incur a 2% monthly interest charge and may result in withheld Lab Work or suspended service.

6. Warranty and Liability for Dental Laboratory Work

• We offer a 30-day remake warranty on Lab Work, provided:
  • The original prosthetic is returned,
  • The failure is not due to poor impressions or incorrect prescription,
  • No unauthorised alterations were made.
• No refunds are provided unless required by law.
• Cases involving design or clinical changes mid-treatment may incur additional charges.

7. Client Responsibilities in Dental Service Agreements

• Practitioners are responsible for:
  • Ensuring patient consent,
  • Providing accurate records and impressions,
  • Final clinical evaluation, insertion, and adjustment of all Lab Work.
• We do not make clinical judgments or diagnose patients.

8. Liability for Dental Laboratory Work

• We take care in producing high-quality Lab Work, but are not liable for:
  • Clinical outcomes,
  • Issues arising from faulty or inaccurate prescriptions,
  • Delays caused by third parties or events beyond our control.
• Our liability is limited to the cost of the Lab Work in question, to the maximum extent permitted by law.

9. Intellectual Property of Lab Work and Website Content

All materials, workflows, designs, and content on our website and in our communications remain our intellectual property and may not be copied, reused, or redistributed without written permission.

10. Confidentiality and Data Protection in Dental Services

We maintain strict confidentiality of patient and practitioner information in accordance with our Privacy Policy. By using our Services, you agree to our handling of personal and health information in line with current Australian privacy laws.

11. Shipping & Risk

• Risk transfers to the Practitioner upon dispatch from our facility.
• We are not responsible for cases lost or damaged in transit.
• Practitioners are responsible for shipping costs unless otherwise agreed.

12. Website Use

By using our website, you agree not to misuse, replicate, or commercially exploit any part of the site without written consent. All content is protected by copyright laws.

13. Amendments

We reserve the right to update these Terms at any time. Updates will be published on our website and take effect immediately unless stated otherwise.

14. Governing Law for Dental Service Contracts

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.
